OS PROCESSOS DE GESTÃO DE POLÍTICAS PÚBLICAS NO BRASIL E SUAS INFLUÊNCIAS NOS PROCESSOS DE JUDICIALIZAÇÃO

Abstract

Despite the advances of the Brazilian State in the implementation and inspection of public policies, there are still many problems to be faced by public managers in conducting state actions. In this sense, this article will seek to discuss the public management of the State's affirmative actions, drawing a parallel between the inconsistencies of the Brazilian management model, the mistakes made by public managers in conducting the State and the increasing search by the target public of the public policies, judicial channels to guarantee fundamental social rights, omitted by the State. With a focus on the processes of forming public policies in a given time frame, we will analyze some errors found in state actions, contained in inspection reports of the Federal Comptroller General, among others, showing the disruptions of the public affairs management processes seeking to demonstrate the possible influences of the formation of the Brazilian Federal State and its cultural and political model in the sometimes disastrous conduct of the State itself.
