HATE SPEECH AND THE COLLISION BETWEEN THE FUNDAMENTAL RIGHTS TO FREEDOM OF EXPRESSION, FREEDOM OF RELIGION, AND HUMAN DIGNITY

This article proposes an analysis of the complex collision between freedom of expression, freedom of religion, and human dignity in the context of hate speech, a phenomenon amplified in the digital age. Grounded in the theoretical foundations of these fundamental rights, it explores the concept of hate speech as a manifestation directed exclusively at minority groups, in accordance with contemporary legal scholarship. The study further delves into the analysis of emblematic concrete cases of hate speech delivered by evangelical pastors against minority groups, such as the LGBTQI+ community and followers of African-origin religions. Such manifestations raise a crucial debate regarding the limits of religious freedom and freedom of expression when confronted with the protection of dignity and non-discrimination. Through a legal and philosophical approach, based on balancing theories such as those developed by Robert Alexy and Luís Roberto Barroso, the article seeks to identify mechanisms of harmonization and criteria for delimiting these rights. The objective is to provide a foundation for the construction of a more inclusive and just society, in which the plurality of ideas and beliefs coexists with mutual respect for the dignity of all individuals.
