The Intensification of Censorship and the Delimitation of Freedom of Expression in Brazil: An Analysis of Control Mechanisms

Abstract

Freedom of expression, constitutionally guaranteed as a cornerstone of the Democratic Rule of Law, faces increasing restrictions in Brazil, often justified by the fight against disinformation and the protection of democracy. This article examines the impact of such restrictions on fundamental rights and the deliberative public sphere through three main axes: the judicialization of criticism, the regulation of digital platforms, and state monitoring. The research adopts a qualitative methodology, with content analysis applied to eight paradigmatic cases, interpreted in light of authors such as Habermas, Dworkin, Rawls, Foucault, and Mbembe. The findings reveal a pattern of institutional instrumentalization that threatens journalistic critique, artistic expression, and democratic pluralism. It is concluded that freedom of expression must be understood not only as an individual right but as a structural condition of the public sphere. Strict application of legality, proportionality, and transparency is essential to prevent protective measures from becoming disguised censorship mechanisms.
